1. Agreement to Terms

By accessing and using Own Your Publishing (https://ownyourpublishing.com), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, do not use this site.

We reserve the right to modify these terms anytime. Changes are effective immediately upon posting. Continued use indicates acceptance.

2. User Eligibility

2.1 Age Requirement

By using OYP, you represent and warrant that:

• You are at least 18 years old (or of legal age in your jurisdiction)
• You are legally capable of entering into binding agreements
• You will comply with all applicable laws

2.2 Age-Restricted Content

Some books and products are restricted to users 18+. By purchasing age-restricted content, you confirm you meet the age requirement.

2.3 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities under your account
• Notifying us of unauthorized access immediately

3. Digital Products (EPUB & Downloads)

3.1 License Grant

When you purchase a digital product:

• You receive a non-exclusive, non-transferable license to download and read the content for personal, non-commercial use
• You do NOT own the content; the copyright remains with the author/publisher
• You may not redistribute, sell, or share the file

3.2 Download Rights & Limitations

• Download links are unique to your account
• Links expire after 30 days for security purposes
• You may re-download during the 30-day window
• After 30 days, contact us to request a new link (free of charge)

3.3 Permitted Use

You may:

• Read the content for personal use
• Print for personal archival (reasonable number of copies)
• Access across multiple devices you own

3.4 Prohibited Use

You may NOT:

• Share files with others
• Redistribute or resell the content
• Modify or adapt the content without permission
• Use for commercial purposes
• Remove copyright or license notices
• Use for training AI models without written permission

Violation of these terms may result in account suspension and legal action.

4. Physical Products (Paperback & Hardcover)

4.1 Print-on-Demand via Amazon KDP

Paperback and hardcover books are fulfilled through Amazon KDP:

• Amazon handles printing, quality, and shipping
• Delivery times follow Amazon's standard timelines
• Shipping costs and rates are set by Amazon/carrier

4.2 Author Copies (Direct Sales)

For author copies purchased directly at events or through special orders:

• Items are non-refundable once printed
• Damage claims must be reported within 5 days of receipt
• Replacements are at author's discretion

4.3 Product Quality

We stand behind our products. If you receive a defective physical product:

• Contact us within 7 days with photos
• We will work with Amazon KDP (for KDP orders) or replace directly (for author copies)

5. Prices & Payment

5.1 Pricing

All prices are listed in USD and include applicable taxes unless otherwise stated.

5.2 Payment Methods

We accept:

• Credit cards (Visa, Mastercard, American Express, Discover)
• Digital payment processors (PayPal, Apple Pay, Google Pay)
• Other payment methods as displayed at checkout

5.3 Payment Processing

• Payments are processed securely through third-party processors
• We do not store full credit card information
• Your payment information is subject to processor privacy policies

5.4 Billing Errors

If you notice a billing error:

1. Contact us within 30 days
2. Provide proof of the error
3. We will investigate and correct within 15 business days

• Physical Products: Returns accepted within 30 days (KDP orders go through Amazon; author copies reviewed case-by-case)

7. Intellectual Property Rights

7.1 Our Intellectual Property

All content on OYP (text, graphics, logos, design) is owned by Own Your Publishing or its content providers and is protected by copyright and other IP laws.

You may NOT:

• Copy or reproduce our design
• Use our trademarks without permission
• Modify or create derivative works
• Use our content for commercial purposes

7.2 Your Content

By uploading or sharing content with us (reviews, feedback, comments):

• You grant OYP a license to use, display, and promote your content
• You represent you own or have rights to the content
• You indemnify us against IP infringement claims

8. User Conduct & Prohibited Activities

You agree NOT to:

Illegal Activities:

• Violate any law or regulation
• Engage in fraud or deception
• Infringe on intellectual property rights

Harmful Behavior:

• Harass, threaten, or abuse staff or other users
• Spam or send unsolicited messages
• Post hateful, abusive, or defamatory content
• Phish for information or attempt hacking

System Abuse:

• Attempt to gain unauthorized access
• Interfere with site functionality
• Use bots or automated tools without permission
• Bypass security measures

Commercial Misuse:

• Scrape content or use automated tools to extract data
• Resell or redistribute digital products
• Use our site for competing services
• Create fake accounts

Violation may result in:

• Account suspension or permanent ban
• Legal action
• Reporting to law enforcement

9. Third-Party Services

9.1 Amazon KDP

For paperback and hardcover orders:

• Fulfillment, quality, and shipping are Amazon KDP's responsibility
• You agree to Amazon's separate Terms of Service
• We are not responsible for Amazon's service failures

9.2 Payment Processors

Payment processing is handled by third parties. You agree to their terms and privacy policies.

9.3 Email Service Providers

Newsletters and communications are managed by third-party email providers. Unsubscribe anytime.

10. Disclaimers & Limitation of Liability

10.1 "As-Is" Disclaimer

OYP and all content are provided "AS-IS" without warranties of any kind, express or implied.

We do NOT warrant that:

• The site will be error-free or uninterrupted
• Content is accurate or complete
• Products will meet your specific needs

10.2 Limitation of Liability

To the fullest extent permitted by law:

WE ARE NOT LIABLE FOR:

• Indirect, incidental, or consequential damages
• Lost profits, data, or business interruption
• Damages exceeding the amount you paid
• Third-party services or content (Amazon, email providers, payment processors)

Our total liability is limited to the amount you paid for the product/service in question.

10.3 Assumption of Risk

You use OYP at your own risk. You assume all risk of:

• Data loss or corruption
• Unauthorized access
• Reliance on third-party services

11. Indemnification

You agree to indemnify and hold harmless OYP, its owners, staff, and partners from:

• Your violation of these terms
• Your violation of any law
• Your infringement of third-party rights
• Claims arising from your use of OYP
• Content you provide or actions you take

12. Account Suspension & Termination

12.1 We May Terminate If You:

• Violate these Terms of Service
• Engage in illegal activity
• Abuse other users
• Attempt unauthorized access
• Repeatedly violate refund or return policies

12.2 Termination Effects

Upon termination:

• Your account access is immediately revoked
• You forfeit unused balance or credits
• Pending refunds may be cancelled
• We retain data per our Privacy Policy

12.3 Your Right to Terminate

You may terminate your account anytime by emailing acndintllc@gmail.com. Once terminated, you cannot recover account data.

13. Dispute Resolution

13.1 Informal Resolution

If you have a dispute:

3. We will respond within 30 days

13.2 Arbitration

If informal resolution fails, disputes are resolved through binding arbitration, not court.

• You waive the right to a jury trial

13.3 Small Claims Exception

You may pursue claims in small claims court if eligible in your jurisdiction.

14. Governing Law

These Terms are governed by the laws of Connecticut, USA, without regard to conflicts of law principles.

15. Severability

If any provision of these Terms is found unenforceable, that provision is severed, but all other provisions remain in full effect.

16. Entire Agreement

These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and OYP.

No other statements or agreements are binding.
